TERMS AND CONDITIONS OF USE OF THE WEBSITE WWW.SBOSTATS.COM, OF THE RELATED SERVICES AND OF THE SMARTPHONE APPLICATION “SBOSTATS”
These Terms and Conditions of Use relate to the website WWW.SBOSTATS.COM (hereinafter, the “Website”), to the related services provided through it (hereinafter, the “Services”), as well as to the Sbostats application which replicates the content and services provided through the Website, all of which are the exclusive property of HUB AFFILIATIONS SRL (P.IVA 10954011218), con sede legale in 80122 Napoli, Vico Dattero a Mergellina n.11, represented by its legal representative pro tempore (hereinafter, for brevity, “Sbostats”).
Anyone who accesses the Website or uses the Sbostats application and/or the Services provided by Sbostats accepts these Terms and Conditions of Use and the Cookie Policy (Sbostats | Cookies); for the specific use of the APP, please refer to the following Cookies (APP | Cookies), which require the users’ express consent and allow them to choose those not necessary for browsing the Website.
Users who register are required to accept both these Terms and Conditions of Use and the privacy notice on the processing of personal data (Sbostats | Privacy), even if they intend to use the free services made available to them through the Website. Any breach of these Terms and Conditions of Use may result in the exclusion of the User, with denial of access to the Website and the services offered by Sbostats, and with any consequence provided for by law.
By ticking the acceptance box provided during registration on the Website and/or by using the Sbostats application or by activating the Services of Sbostats (in which case following subscription and payment for the same), you accept and agree to be bound by these Terms and Conditions of Use. In the case of use of the Website by unregistered users, by choosing to browse the website sbostats.com, such users are nevertheless required to comply with these Terms and Conditions of Use.
1. REGISTRATION
1.1 In order to use the paid services of the Website and the Sbostats app, the User must register by completing the form available on the Website or on the app with the following mandatory personal data: first name, last name and email address. Alternatively, the User may register using their Google or Facebook accounts; in such case, the same personal data required by the registration form will be shared with Sbostats: first name, last name and email address.
At the time of registration, the User must accept these Terms and Conditions of Use and provide any additional consent in relation to further notices submitted to them. Access to the Website, the app and the Services is subject to Sbostats’ acceptance of the User’s request.
1.2 The User undertakes to provide truthful, accurate and complete data. In the event of a breach of this provision, Sbostats reserves the right to prevent the User from accessing the Website, the app and/or the Services, in whole or in part, temporarily or permanently.
1.3 Use of the Website, the app and the Services by persons under the age of 18 (eighteen) years is expressly prohibited.
1.4 During registration, the User will be required to choose a password which must be kept with due care, with the express prohibition of transferring and/or disclosing to third parties the access credentials for the Website or the app relating to their profile (account). In the case of registration via Google or Facebook accounts, the initial password will be the one chosen by the User for those services, but it may subsequently be changed using the relevant function available in the User’s profile page on the Website.
1.5 If the User suspects that someone has become aware of their access credentials, they must contact Sbostats so that appropriate protective measures may be adopted. Where Sbostats ascertains a breach of the prohibition set out in clause 1.4, it reserves the right to block and/or delete the User’s accounts.
1.6 Password recovery may be carried out automatically through the procedure provided on the Website and on the app, subject to the User’s identification; the User will receive instructions for changing their password at the email address provided during registration.
1.7 The User shall be held responsible, within the limits of the law, for activities carried out through their account on the Website and on the app owned by Sbostats, and hereby indemnifies and holds Sbostats harmless from any damage, compensation obligation and/or sanction arising from any breach of the prohibitions set out in the preceding clauses.
2. FREE VERSION AND ADVERTISING ON THE WEBSITE/APP
2.1 The User who does not register will have access to a “free” version of the Website and the app, which provides limited functionality. Use of the Website and the app implies acceptance of these Terms and Conditions of Use.
2.2 While browsing the Website and the app, the User may see third-party advertising content and messages in the form of banners visually distinct from the Website/App content and statistical data. Such advertising is promoted through the Google AdSense and Google AdMob networks, operated in Europe by Google Ireland Ltd., with no connection to Sbostats, which merely hosts these spaces within its Website and App.
Sbostats shall not be liable in any way for the content, information and services/products promoted through the above advertising banners on its web pages and within its app.
A User who has subscribed with Sbostats to a PRO subscription service will be able to use the App without viewing advertising banners, which will in any case remain visible on the Website
3. SUBSCRIPTION PACKAGES, PURCHASE OF ADDITIONAL SERVICES, TRAINING COURSES AND COSTS
3.1 After registering and validating their account via the OTP code sent at the time of registration, the User will be enabled to purchase one of the subscription packages and the Additional Services offered by SBOStats.
If the User provides their Telegram username, thereby expressing their wish to join the Groups managed by Sbostats on that digital platform, they may participate in the Groups reserved for users who subscribe to specific paid Additional Services.
3.2 The User may view the costs of the subscription Services and of the Additional Services (where available) via the following link https://www.sbostats.com/prices and via any other links which will be made available by Sbostats.
The video courses and training services offered by Sbostats are presented via the web pages https://camossisportinvest.com/investimenti-sportivi/ and https://formazione.sbostats.com/, owned by Sbostats, through which the User may book a free consultation before proceeding with any purchase.
The purchase of the video courses and additional training services offered by Sbostats is possible after registering on the website sbostats.com. They will be accessible to users who have purchased them after further registration on the web portal https://circle.io/, since they can only be used by accessing that portal. Registration will also grant access to the group/page https://grow.camossisportinvest.com/home, also managed by Sbostats.
For some of the above digital products (video courses/training services), an annual membership is provided, allowing use for 12 (twelve) consecutive months. For such products, where the purchase was made by credit card, renewal will be automatic upon expiry for a further 12 (twelve) months, provided that the User does not choose to deactivate it. A purchase made via PayPal or bank transfer does not provide for automatic renewal. The service must therefore be renewed by the User upon expiry of the membership by accessing their account via the following link https://www.sbostats.com/camossisportinvest_my_account or by contacting customer support at formazione@sbostats.com.
3.3 Payment for the subscription Services, the Additional Services and the training services via the website may be made using one of the following methods, including in combination: Credit Card (via the Stripe provider), PayPal and bank transfer. Payments are handled by external operators, who shall be solely responsible for the relevant transactions, over which Sbostats cannot exercise any control and for which it assumes no liability.
Payment may also be made directly in the app, in accordance with the methods provided by the Store with which the User is already registered (e.g. Apple Store/Google Play); this functionality is available exclusively for the subscription services and for users who created their first account via the App. Transactions will be managed directly by the relevant Store and, therefore, Sbostats assumes no liability in respect of them.
3.4 Subscription packages have a duration of 30 (thirty) days regardless of the type chosen by the User and renew automatically upon expiry of the relevant period for an analogous period, except where the User selects the option which does not provide for automatic renewal (a function available only in the web version of Sbostats and only after the first purchase).
3.5 By subscribing to the subscription services, the User acknowledges and accepts that the price paid for them and/or for the additional services may under no circumstances be refunded.
3.6 The Additional Services Telegram Bot and Money Management involve a one-off payment and function exclusively provided that there are active PRO subscription Services; whereas the video courses, which also involve a one-off payment, are always usable after purchase. A User who deactivates their subscription Service and reactivates it within 12 (twelve) months will not need to repurchase previously purchased additional Services, but must request their reactivation from Sbostats. If reactivation of additional Services is requested more than 12 (twelve) months after the last expiry, the User will be required to repurchase them and will lose all saved data created during their previous use.
3.7 By means of separate registration and the creation of a specific account via the web page https://camossisportinvest.com/apocalypse/, the subscription service called “Apocalypse” may be activated (its features are described on that web page), a service managed by Sbostats.
Two different subscription plans are available: (a) a monthly plan, lasting 30 (thirty) days; and (b) an annual plan, lasting 365 (three hundred and sixty-five) days.
Both subscription plans renew automatically where the User chooses to pay by credit card (payment handled by the Stripe provider). Choosing a different payment method among those permitted (PayPal/bank transfer) entails manual renewal of the subscription plan, which the User must carry out upon expiry in order not to interrupt the service.
4. RIGHT OF WITHDRAWAL
4.1 Following registration on the Website or App and completing the
relevant form — or through the use of Google/Facebook accounts — with the
required personal data, the User accesses the full statistical Service provided
by Sbostats.
Upon payment of the price provided for the subscription Services,
the User expressly agrees to waive the right of withdrawal pursuant to Article
59(a) of Legislative Decree No. 206/2005 (the Italian Consumer Code), since,
following activation of the Services, the User obtains the complete provision
of the same.
4.2 The above also applies in the case of purchase of one of the
additional Services referred to in clauses 3.2 and 3.7 and of all training
services offered, given their immediate and complete availability following
purchase and the resulting access to the platform.
4.3 Use of the Services shall mean any action aimed at consulting
the statistical data or the information provided through the Website and/or the
additional Services.
4.4 Under no circumstances shall the User be entitled to full or
partial refunds of amounts paid in relation to subscription Services,
additional Services and Video Courses.
4.5 A
User who requests the deletion of their profile (account) registered with
Sbostats will no longer be able to access the Services previously subscribed to
unless they register again and pay for those they wish to use. They will also
not have access to the history of activities carried out under the previous
registration. Deletion of the account must be requested via the contact form
available both on the Website and on the App.
5. DISCLAIMER
5.1 The Services offered by Sbostats constitute statistical tools
based on the outcomes of sporting events with reference to the odds associated
with them by bookmakers. Statistical data are updated at the end of the events
to which they refer.
5.2 Sbostats is not a sports betting website, but a statistical
database. The Website/App does not allow sports bets to be placed directly.
5.3 The Website/App includes a service called “Schedina Virtuale”
(“Virtual Bet Slip”), which allows sporting events to be selected and
bookmakers’ odds to be displayed among those available on it. Sbostats assumes
no responsibility for the reliability of the bookmakers’ odds shown on its
Website/App, nor for any losses the User may incur, since the User bears sole
responsibility for their choices in relation to authorised gaming. A User who
intends to place one or more sports bets using the bookmakers’ odds shown
within the Website/App will be redirected to the chosen bookmaker’s website or
app, with which they will manage such activities independently and
autonomously.
5.4 Sbostats undertakes to preserve the privacy of its Users and
processes their data in accordance with applicable law (GDPR and the Italian

5.5 Neither Sbostats nor any of its commercial partners may be held
liable for any losses that may occur as a result of using the statistical data
made available to users. Accordingly, Sbostats does not guarantee winnings and
cannot be held liable for losses arising from the use of such data, or for any
errors in their processing and subsequent use by users.
5.6 By using the Services provided by Sbostats, the User accepts
the inherent risk in any sports bet they may place, since sports betting and
online gaming may result in the loss of the entire capital invested. The User
therefore indemnifies and holds Sbostats and any of its commercial partners
harmless from any liability for any losses arising from such activities.
5.7 Sbostats disclaims any liability for any damage arising from
inability to access the Services provided, or for any damage caused by viruses,
corrupted files, errors, omissions, interruptions of the Services, deletion of
content, network issues, problems related to providers or telephone and/or
telematic connections, unauthorised access, data alteration, or malfunctioning
or defective functioning of the User’s electronic equipment.
5.8 Sbostats may therefore not be held liable for damage resulting
from failure to provide the Services due to incorrect or failed operation of
electronic communication tools, or for causes outside its foreseeable control.
By way of example, but not limited to, this includes malfunctioning of servers
and other electronic devices even if not an integral part of the Internet,
malfunctioning of installed software and of the Internet, computer viruses and
any presence of other harmful or damaging software components, as well as
actions by hackers or other users with access to the network. The User
undertakes to indemnify and hold Sbostats harmless from any liability and/or
compensation claim arising from or connected with the events described above.
5.9 Sbostats may not be held liable for non-performance due to
causes and events that are not reasonably foreseeable, or to impediments beyond
its direct and immediate control, or arising from force majeure.
6. INTELLECTUAL PROPERTY
6.1 All contents of the Website and the Services offered by
Sbostats, without limitation, including texts, graphics, logos, photographs,
audio or video content, are the exclusive property of Sbostats and may not be
copied and/or reproduced by Users. Use of such content must comply with these
Terms and Conditions of Use and with any other different provisions and
indications communicated by Sbostats through the Website, the app, the Services
and any means of communication used by Sbostats.
6.2 The User may not modify or otherwise commercially exploit
Sbostats’ content. It is not possible to assign, sublicence or otherwise
transfer one’s rights under these Terms and Conditions of Use. It is also not
permitted to share with third parties the information and content to which the
User has access.
7. USER CONDUCT
7.1 The User undertakes to behave correctly and appropriately when
using the Website, the app and the related Services.
7.2 The User undertakes to indemnify Sbostats against all losses,
damages, liabilities, costs, charges and expenses (including legal fees)
incurred by Sbostats as a consequence of any breach by the User of the
obligations assumed by accepting these Terms and Conditions of Use and/or in
any event arising from the User’s use of the data published on the Website
and/or obtained through the additional Services offered by Sbostats; this also
applies in the case of legal actions brought by third parties against Sbostats
for facts and conduct attributable to the User.
7.3 The User hereby declares that they will indemnify and hold
Sbostats harmless from any liability and burden in the event of complaints,
legal actions, administrative proceedings, losses or damages which Sbostats may
suffer due to the unlawful use of the Website and/or the Services by the User.
8. ACCOUNT DELETION
8.1 Sbostats reserves the right to remove the User’s account, at
its sole discretion, where it believes that the User’s conduct has breached
these Terms and Conditions of Use in whole or in part, or where the User has
engaged in improper and/or fraudulent use of the Website and/or the Services
which may result in actual or potential harm to the rights and interests of
Sbostats and/or third parties.
9. APPLICABLE LAW AND
JURISDICTION
9.1 These Terms and Conditions of Use are governed by Italian law
and the laws of the European Union. Should any disputes arise regarding their
interpretation and performance, they shall be governed by the applicable
legislation.
